English: Photograph of American singer Frank Sinatra with a bronze bust of himself sculpted by Jo Davidson on commission by Modern Screen magazine. The bust was given to Sinatra in honor of his first-place finish in the magazine's annual poll of its readers' favorite Hollywood star. According to Heritage Auctions, Davidson produced the sculpture in an edition of 25 copies. A WorthPoint listing—selling what was believed to be the sculpture given to Sinatra—claimed that about there were 20 smaller copies and 4–5 full-size copies made.

English: No permission is required because the photo entered the public domain after its initial 28-year copyright term expired on January 1, 1975. The 1946 issues of Modern Screen were not renewed in the 1974 Copyright Catalog, and so copyright expired and these issues entered the public domain (note that the issue was dated Jan. 1947, but copyrighted 1946). See Copyright Catalog (1974) Periodicals: Original registrations and renewals, page 486, where Modern Screen would be expected to appear alphabetically if it had been renewed.
  • Note about Davidson's sculpture: At the time of upload on September 2, 2020, Davidson's sculpture of Sinatra may still under copyright, and will remain copyrighted until January 1, 2023, when the 70-year period following Davidson's death in 1952 will expire. Nevertheless, this 2D photograph is in the public domain—even if the 3D sculpture is not—because Modern Screen not only published the photograph of the sculpture but also commissioned the sculpture itself for the express purpose of photographing it for publication in its January 1947 issue. The published photograph was therefore a collective work for hire, for which Modern Screen was the sole corporate copyright holder (until the copyright term expired). Any aspect of the 3D sculpture disclosed by the publication of this 2D photograph also entered the public domain. However, note that if the 3D sculpture is still copyrighted, then other photographs of the same sculpture would be derivative works and, potentially, violations of Davidson's underlying copyright in the 3D sculpture—at least prior to January 1, 2023.
