Důležitá poznámka: Díla cizího původu (mimo USA) musí být pro přijetí na Commons volná či svobodně licencovaná jak v zemi původu, tak ve Spojených státech. U děl čínského původu, která se v USA stala volnými z některých zvláštních okolností (např. vydání bez dodržení příslušných amerických formalit), se mohla autorskoprávní ochrana obnovit na základě smlouvy URAA, pokud bylo dílo v zemi původu chráněno ke dni, kdy pro danou zemi nabyla účinnosti URAA. (Pro Čínskou lidovou republiku je tímto dnem 1. leden 1996. Pro Čínskou republiku (Tchaj-wan) pak 1. leden 2002.[1])
